Compliance and integrity

Our steadfast commitment to compliance allows us to continue our vital work: connecting thousands of people with the healthcare they need.

The PAN Foundation is a national, nonprofit organization with 501(c)(3) tax-exempt status. Its mission is to help underinsured people with life-threatening, chronic and rare diseases get the medications and treatment they need by paying for their out-of-pocket costs and advocating for improved access and affordability.

As the Office of Inspector General (OIG) has stated, “Patient assistance programs (PAPs) have long provided important safety net assistance to . . . patients, many of whom have chronic illnesses and high drug costs.” In accomplishing its mission, the PAN Foundation is committed to full compliance with all applicable federal and state laws, regulations and government guidelines.   

In recent years, various governmental entities, such as the OIG of the U.S. Department of Health and Human Services, have issued guidance related to the operation of PAPs, such as the PAN Foundation. Among these guidance documents are an OIG Special Advisory Bulletin, Supplemental Special Advisory Bulletin and various Advisory Opinions. The PAN Foundation endeavors to operate in full compliance with these guidance issuances.

Accordingly, the PAN Foundation has adopted and implemented a comprehensive compliance program to ensure that it fully meets its legal, ethical and fiduciary obligations. This program incorporates the seven core elements identified by the OIG as necessary for an effective compliance program. If a PAN Foundation employee, contractor or other stakeholder has a compliance-related concern or issue, they are encouraged to report it for review and appropriate action by the PAN Foundation compliance department.

Compliance Program

In furtherance of its mission, PAN is committed to complying with all applicable laws and regulations, including but not limited to the Anti-Kickback Statute, the federal Civil Money Penalties Law and laws and regulations governing tax-exempt organizations. Moreover, to ensure compliance with the aforementioned laws, PAN operates under an Advisory Opinion (as modified) issued by the Office of Inspector General (OIG) of the U.S. Department of Health and Human Services (DHHS).

Commitment to compliance and integrity

A confidential Compliance Hotline is available for employees and others to report fraud, waste or abuse concerns/issues anonymously. If someone knows or suspects that a law, regulation or organizational policy or procedure is not being followed, it should be reported. The PAN Foundation has a non-retaliation policy regarding reporting of compliance issues or concerns and our compliance office will review and address any reported issues.
